One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. Hello -
I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

I have EAD, AP and H-1B. I don't have H-1b stamped on my passport. I would like to travel on AP.
According to my lawyer;
"For every paper (AP) you have, you can make one trip with it. So if you have 3 original papers, you make 3 trips in and out of the country."
Is this true? My friends who traveled outside the country were told at the port of entry that AP can be used for multiple entry and the above does not hold true.
Any insight would be appreciated.

We need to make a very important decision this weekend and any help will be highly appreciated.
My husband�s (EB3/India) employer is willing to give us a �Labor Substitution/I-140� (PD: March 2005). But, I really want to apply for COS H4 to F1.
So the two options we have is
1) Apply for both �Labor Substitution/I-140� and COS H4-F1
2) Apply for COS H4-F1 and let go of �LC Sub�.
I have spoken to a lawyer and he is saying that we can apply for both �LC Sub� and COS and that there is a very good chance that COS will also go through, although there is a very small risk. But, I am getting conflicting messages from other sources suggesting there is a high risk of COS being denied.
We are trying to determine the amount of risk we are taking if we apply for "LC Sub" and COS at the same time. If the risk is high, that we would just apply for COS H4-F1.
This is a really tough decision and any advice would be greatly appreciated.

Hi Guys
Let me make this suggestion, instead of trying to organize statewide, organize aroound each of the senators offices in a state. In this way you can get more people to join as they ahve to travel only short distances to meet, and you can also make more of an impact by giving the senator input from multiple local offices instead of one central office.
I just met and spoke to Sen Schumers office locally and explained our problems, and showed our presentation, they said they will convey it to the senator. I urge you to do the same
Also start the process if meeting your hosue reps as well, as this would be crucial too, to get this thru

I am one of the July filers, have EAD and applied for I485 EB3, Dec 2003 India. My H-1 And GC are both based on the job title- Systems Programmer/ Network Admin. I wanted to apply for a position in the university - Lab Director- Electrical & Computer Engineering. My question is :
1) Since not all the job responsibilities will be same in the new job (if i get it). but some ofthe requirements will be the same.
[like setting up the network, little programming devices etc.]
2) Can I apply for EB-2 with the university and later port my date- Eb3 to EB2
Pls let me know at your earliest convenience

Hi,
I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. Friends - anyone here who has applied in PERM where job required B.S + 2 - 4 yrs of experience? Mine is a Job zone 4(sr. software engineer), requires B.S + 30 months and in the PERM form the lawyer has entered 'No' to H12 question 'Is this normal requirements'. Were they right? Or should I be worried? Anybody can share any experience? Thanks!

I have an approved I-140 in the EB 2 category and I'm changing my employer next month. However, my current lawyer emailed me this morning saying that you can transfer your PD, but not in the same category (EB2). In other words, to keep my PD, I will have to apply through EB1 or EB3 with my new employer. I had not heard of this before and was wondering if this is a true statement. Has anyone successfully transfered their PD within the same category? Thanks.

Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers. I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.
