    HELLO FRIENDS,

    I am not sure if this has been ever discussed or no but will appreciate any pointers on it : Can one keep extending the H4 visa even if EAD is been used?

    The law requires that you report any and all change of address change within 10 days of the change.
    You can choose to use the online tool and complete an electronic Form AR-11 and notify USCIS to update your address on most pending cases. However, if you choose to do it by paper, then AR-11 will not update your address on any applications or petitions pending with USCIS.

    6 users are maybe same person owner/employee of others sites? They lose money for IV success. So hate IV.

    Yes exactly. one of them is most likely the moderator of the forum. The rest are likely paid by someone, I won't be surprised it they're from other immigration forums or competing lawyer websites. Out of tens of thousands only these 6 consistently speak against IV.

    I don't care them but they are influencing others to believe in them.

    I believe same. Those minds are not only selfish but they are really really cruel, cunning and they don't deserve to be part of american dream.. All they care is their green card...

    Yes I feel no one can be that cruel consistently, they have to be pros in bad PR. Its just a joke - I have been tracking :) one user create 5 IDs and use the same broken english over 3 months. Its also highly likely some of them are paid by that website itself

    Today's Date: 09 Aug 2010

    1)I graduated in masters in december 2008.Iam working on OPT extension which expires on june2,2011.Iam thinking to apply for H1.Accordint to current situation,can i submit H1 application after october 2010 also? as CAP will be still open for masters quota(hoping)?can i put start date immediate after my opt status expiry date or it will start only on conventional date oct1st of every year?

    2) Iam planning to fly India in between mar 2011 -may 2011 for 1month...so if iam approved with H1(if above questions says yes) then i need to go to H1 stamping and when i enter US ...i need to change my status from opt to H1 right at US entry.

    3) if iam going in apr/may 2011 when should i start the H1 processing?(it should be before 6months only)

    Hi,

    My scenarios is this:

    > Got approved H1-B petition and visa stamped till 31st July, 2011
    > Traveling to US on June-15, 2011
    > Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011

    1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
    2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?

    Appreciate any inputs on this.

    Hi,
    I got my EAD recenltly and my I140 approved long time back but my employer is keeping my I140 receipt number as a secret (both HR and attorney). Is there any way i can get I140 receipt number? do i need this if i want to use AC21 before or after 180 days ?

    Hi

    I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.

    I have 2 questions here.

    1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
    Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.

    2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).

    Please advice, I will really appreciate your suggestions on this ASAP.

    Hi

    I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.

    Is this correct? Or is the lawyer being overly cautious?

    If such a rule does exist can you please point me to the exact regulation?

    Hi

    I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.

    I did not get stamped yet as i never leave US until now.

    Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .

    When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

    I am going to my country on August 2nd week for my marriage and my questions are.

    can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?

    can i use the notice as the proof of I129 in case they need it for stamping?

    Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

    Gurus..I need some help

    My I-140 is approved. I recently got 3 year extension and I am in my 7th year currently.
    I may get a better offer. My question is
    1. Since I have a new H1b which is valid for 3 years (for H1b year 7,8 and 9), can I transfer it to a new employer?
    2. Also, the new employer is willing to file GC, can I use my old PD date. (the new job profile is similar)
    3. If the current employer withdraws my I-140, will that affect my H1 transfer?

    Please help.

    so. But since your 140 is approved the PD is yours. You have to find new employer, start from Labor process again.

    I applied for H -1 extension regular processing in the month of sept 2009 in california service centre before expiration date of my H1-B(2010 Jan 22).I got RFE on DEC 18th asking for client and contractual agreements between client and vendors and i got time til Jan 29th 2010 to reply back to RFE.As i was preparing to collect all the documents to respond to my RFE ,I also applied new H 1 from same existing employer before Jan22nd 2010 in Vermont service centre.I replied back to RFE on jan 27th 2010 with client letters and letters from 2 vendors.
    I got my H 1-b extension approved from California service centre on Feb 18th 2010

    My question is what if my new H1 filed in vermont service centre gets rejected.Will it cause any problems to the extension that was approved.I already got my h1-b extension approval notice from uscis on FEB 18th 2010.I have'nt heard anything about my new h1 b filed on jan 21 2010 in vermont service centre.Can i continue to work on my approved extension.
    Please advice me

    Normally when you Get an RFE there are very goodChances of getting your Application processed pretty soon
